Terms of Use

These Terms of Use (the “Terms”) apply to your use of masterfit.net (the “Site”), operated by Masterfit Medical Supply (“Masterfit Medical”, “we”, “us”). By using the Site or placing an order through it you agree to these Terms. If you are ordering on behalf of a business or organization, you confirm that you are authorized to do so.

1. Accounts

Ordering on the Site is available to existing Masterfit Medical customers with a login. You are responsible for keeping your login details confidential and for all activity under your login. Each login is linked to a Masterfit customer account; the pricing shown while you are logged in is specific to that account and may not be shared.

2. Pricing and availability

Prices and availability shown on the Site are updated regularly from our business system, but they may change between the time you view a product and the time your order is processed, and they are subject to confirmation by Masterfit Medical. If a product is listed at an incorrect price or with incorrect information, we will contact you before filling the affected order.

3. Orders and billing

Orders placed on the Site are placed on your Masterfit account and are invoiced under the terms of that account. No payment is taken on the Site. Shipping and taxes are not shown online; they are added at the time of billing. An order confirmation means we have received your order; we may limit quantities or decline an order, and we will contact you if we cannot fill it as placed.

4. Product information

Product descriptions and images are provided by manufacturers and distributors and are for identification only; packaging and specifications may change without notice. Some products may be sold only to licensed professionals or facilities under federal or state law. Product information on the Site is not medical advice; the selection and use of medical products is the responsibility of the licensed professional.

5. Warranties and limitation of liability

Products are covered by the manufacturer’s warranty, if any. Except as expressly stated, Masterfit Medical makes no warranties of any kind, express or implied, including the implied warranties of merchantability and fitness for a particular purpose, regarding the products or the Site. To the fullest extent permitted by law, Masterfit Medical and its suppliers will not be liable for any indirect, incidental, special or consequential damages arising from the products or from the use of the Site, and our total liability for any order will not exceed the amount you paid for that order.

6. Use of the Site

The material on the Site, such as text, graphics, logos and images, is the property of Masterfit Medical or its content suppliers. You may use the Site to browse and order products for your organization’s use. Scraping, automated data collection and republication are not permitted without our written permission. Our Privacy Policy explains how we handle your information. We may suspend or end access to the Site at any time, and we may revise these Terms by updating this page.

7. Governing law and contact

These Terms are governed by the laws of the State of Tennessee. Any dispute arising out of these Terms or an order will be brought in the state or federal courts located in Madison County, Tennessee.
